WICHITA AND AFFILIATED TRIBES RESPOND TO EXECUTION OF NEW OTOE AND COMANCHE GAMING COMPACTS

The Wichita and Affiliated Tribes stands united with other Oklahoma tribes who are opposed to the terms of the new gaming compacts agreed to on April 21, 2020, between Oklahoma Governor Kevin Stitt and the Otoe-Missouria Tribe and the Comanche Nation President Terri Parton said Wednesday.

These new compacts are an unfortunate development, not just in in tribal gaming, but in tribal-state relations,” Parton said. The compacts appear to violate federal and state law, and introduce a lot of instability that the existing compacts were designed to avoid.  These two new agreements set up direct conflicts among tribes over current tribal gaming boundariesadd more regulatory burdens, and allow the state to terminate them before they expire.

The new agreements also allow the state to expand its own gaming offerings, including more internet-based “iLottery” and sports wagering.  

“The aspects of the new agreement signed on April 21, 2020,could have devastating consequences.  If the new compacts were deemed lawful and became the norm, the financial instability introduced by their terms along with the contemplated state-run competition would hurt everyone who benefits from jobsroads and health care in rural Oklahoma  said President Terri Parton. 

Parton said there was also a question about whether the money paid by tribes under the new agreements would go toward public education as under the current gaming compacts.

“Under the existing compacts, the tribes have provided more than three times the money for Oklahoma education than even the most optimistic estimates predicted when the State-Tribal Gaming Act was passed in 2004,” Parton said.  Tribes have brought in far more money for education than the lottery has, all while bringing jobs, infrastructure and services to rural Oklahoma.

Parton said another troubling aspect of the new agreements is that they grant the Governor and the Office of Enterprise Management Services many new powers over tribal gaming that they did not possess before.

The new compacts give state oversight to people, who are more than likely inexperienced in tribal gaming and who are also hired by the state and not the tribes, control over management and regulatory decisions instead of experienced tribal gaming leadership and tribal regulating authorities,” Parton said. “Tribes have been successfully operating and regulating gaming in various forms since at least the early 1980s with additional oversight from the federal government since 1988.  Tribes operating gaming facilities know what they are doing, as evidenced by the success of Oklahoma’s tribal gaming industry. But now Governor Stitt is trying to run and regulate our businesses while he’s also competing against us with iLottery.

Parton said the Wichita and Affiliated Tribes will not join in the new agreements.

The Wichita and Affiliated Tribes commitment to the other United for Oklahoma tribes is strong,” Parton said.  “We have a right to continue gaming under our existing compact, which renewed on January 1, 2020, and we will continue our fight to defend that agreement from Governor Stitt’s attack.”

We see this effort by the Governor as an attempt to divide the tribes and pit them against each other,” Parton said.  The Governorwho claims he is for all Oklahomans, produced a compact that would potentially pit tribes against each other and take us back to the old days where tribes were in constant conflictThe compact signed yesterday would hindetribal advancementharm tribal people and tribal communities.  The Wichita Executive Committee will continue this fight for our tribal people, the future of our children and our tribal sovereignty.”
